The case was registered against MQM leaders at a New Town Police Station.
MQM chief Altaf Hussain is nominated among other party leaders including Khalid Maqbool Siddiqui, Salman Baloch, Haider Abbas Rizvi, Nasreen Jalil and Rasheed Godil in the case.
The report submitted before the court stated that Haider Abbas Rizvi and others are absconding. While MQM chief is out of country. Similarly, MQM’s mayoral candidate for Karachi Waseem Akhtar and Rauf Siddiqui are on bail hence they could not be arrested, the court was told.
On Jan 15, the ATC had acquitted MQM Senator Tahir Mashhadi in a hate speech case.
Mashhadi was accused of facilitating and listening to his party chief’s speech criticising the military establishment.
The investigating officer On December 5, 2015 had informed the ATC that the Mashhadi was not chargesheeted in an investigation report for lack of evidence and was discharged under Section 169 (release of accused when evidence deficient) of the criminal procedure code.
The investigation report said that Senator Mashhadi was not found among the audience at the party headquarters during the speech of MQM chief Altaf Hussain in which he had criticized military establishment.
