A member of FIA investigation team Maqsood ul Hassan while recording his statement in the court said that the inquiry team after collecting papers had reached to the conclusion that a case of violating the constitution can be registered against Pervez Musharraf. The investigation team dispatched its report to the ministry of interior, he said.
A three-member special bench headed by Justice Faisal Arab hearing the case against former military ruler Pervez Musharraf.
The witness informed the court that the governor of Punjab Lt. Gen. (retd) Khalid Maqbool in his written statement has informed that he was not consulted for proclamation of emergency.
He said the team visited the residence of Pervez Musharraf to record his statement but his security advisor informed the team in written that the former president has been ill and could not record his statement.
The witness submitted notifications regarding proclamation of emergency, prohibiting judges from their duties, new oath to judges and appointment of Sharifuddin Pirzada as advisor in the court.
Defence counsel Farogh Naseem objected that Sharifuddin Pirzada was the counsel of Musharraf and a lawyer could not be included in the case. Prosecutor Akram Shaikh argued that the notification not belongs to Sharifuddin Pirzada as counsel, but it is about his appointment as advisor equal to minister of state.
After the prosecutor’s argument the objection of defence was rejected.
The bench will review the audio-visuals of Musharraf’s speech in the courtroom tomorrow.
