Supreme Court cancels reinstatement of Sukkur education officer

KARACHI: A Supreme Court bench on Monday declared the provincial government’s decision of reinstatement of an education officer without departmental procedure, as null and void.

According to ARY News, Justice Gulzar Ahmed during hearing of a case at the apex court’s Karachi registry,  about restoration of DEO Sukkur Abdul Ghaffar Mahar without any summary, came hard on the Chief Minister of Sindh and called the decision an example of blatant favoritism.

It is a farce and injustice with the people and an example of the discriminatory behaviour of the rulers, the Justice remarked.

Justice Gulzar questioned, how a chief minister could take decision without any departmental procedure? Who gave this power to the chief minister to reinstate someone without any summary from the department, the apex court judge asked.

The court ordered the government decision of reinstatement of the education office Abdul Ghaffar Mahar as void and directed for stopping payment of salary to the officer.

The court also sought explanation from the chief minister of Sindh and the provincial chief secretary over the matter.

According to Additional Advocate General Abdul Ghaffar Mahar was accused of making illegal recruitment. The chief secretary had recommended termination of his service. Former chief minister Syed Qaim Ali Shah terminated service of the officer in year 2015 but reinstated him in 2016. Chief Minister Syed Murad Ali Shah retained his predecessor’s decision in the matter.

After the government’s decision other officials who were illegally recruited filed a petition in the court and pleaded for their reinstatement on the job like Ghaffar Mahar.
