21st Constitutional Amendment, Army Act challenged in SC

The petition, filed by Barrister Zafarullah, states that the powers of the judiciary and the executive cannot be merged whereas the constitution does not allow legislation which is against the basic human rights.

It is further mentioned that the Supreme Court has already given a verdict against the formation of military courts therefore the constitution of special courts come under court contempt.

The amendments in the constitution and the Army Act were passed by both houses of the Parliament on Tuesday. Jamiat Ulema-e-Islam – Fazl (JUI-F), Jamaat-e-Islami (JI) and President of Awami Muslim League (AML) Shaikh Rasheed Ahmed did not take part in the voting.

The political parties of the country, in a multi-party moot, had agreed to make amendments in the constitution to provide legal cover to the formation of military courts in the country.
