Landmark Verdict: SC orders heirs of late clerk to pay fine of father's crime

ISLAMABAD: Supreme Court of Pakistan in a landmark verdict ordered the heirs of a deceased corruption accused to pay fine for their late Customs clerk father, ARY News reported on Thursday.

A bench of the apex court headed by Chief Justice Asif Saeed Khosa ordered the family members of deceased clerk Mohammad Zamurrad to pay fine imposed on their father in corruption case.

The bench, however, slashed the amount of fine from 17.7 million to four million.

“No doubt offender was their late father but the law commands recovery of amount even from the slaves of a person who commits crime,” Chief Justice Khosa said.

“Mr Zamurrad was appointed as an upper division clerk and the salary of a clerk in 1976 would likely be around 450 rupees”, the CJP observed.

“His children were studying at Lawrence College. Everyone will question if the wife of a Customs clerk purchases property,” chief justice said.

The counsel of petitioner said that a son of late Zamurrad was sending money to father from London.

The money used to be transferred from here through Havala and sent back from abroad via Telegraphic Transfer (TT), chief justice remarked.

“What is relation between late accused and the petitioner,” the chief justice asked from the counsel. “Petitioner is a lawyer and son of the late clerk,” the lawyer informed the court.
