The Lahore High Court (LHC) Bar had filed a petition challenging 21st Amendment and military courts in the SC.
The apex court after the initial hearing had sought an answer from the federation and all the four provinces.
The Government of Khyber Pakhtunkhwa (KP) has submitted its reply stating that it is the Parliament which has the authority to amend the constitution, while military courts were formed for speedy trials and safety of witnesses, in view of growing terrorism in the country.
It was
further stated that military courts are not a parallel judicial system, this is a temporary system which will be ended under the same amendment within two years and so it should not be misunderstood as a contradiction of the constitution and independence of judiciary.
Meanwhile, separate petitions were filed against the 21st Amendment and military courts by the Supreme Court (SC) Bar and Pakistan Bar.
Pakistan Bar has also announced to observe a ‘black day’ on Thursday, in protest against the formation of military courts.
