Special Court calls for re-investigation into Musharraf treason case

The Special court has also called for former Law Minister Zaid Hamid to be investigated in the treason case. Hence, it directed the FIA and not the Joint Investigation Committee to conduct the probe.

In their brief order at a court presided by Justice Faisal Arab and comprising of Justice Sayyida Tahira Safdar and Justice Muhammad Yawar Ali, the judges said that even the government’s prosecuting attorney Akram Sheikh had admitted that there were loopholes in the case, hence there was a need for re-investigation.

The court stated that under these circumstances, not only Pervez Musharraf but his associates, which included former Prime Minister Shaukat Aziz, former Chief Justice of Pakistan Abdul Hameed Dogar and ex-Law Minister Zaid Hamid should also be investigated.

They also said that the High Court’s decision regarding the Joint Investigation was not in accordance with the law, since as per Article 6 of the Constitution, only FIA can conduct a probe, hence it is the Federal Investigation Agency who should conduct the investigation.

Further proceedings were postponed till 17th December and on the next hearing, the prosecutors would inform the court regarding the details. If the investigation is not completed, the court will be informed regarding whose statement has been recorded and how much time is further needed to conclude the trial.
