judicial remand

Judicial Remand: A person is in the custody of the court after the expiry of Police remand or if Police remand is not granted when the person is produced before the magistrate.

Judicial remand is being sent to jail. The jail is supposed to keep custody of the accused on behalf of the court.

Technically, a person has to be first ‘arrested’ to be presented in court. So a person may be ‘picked up’ for questioning and kept in the police station for several days.

After the police extracts most of the information and cracks the cases, he is formally ‘arrested’ and then produced in the court. At this stage also, police may ask for more time (now remand) to question the accused.
