AAG rejects Sharif family's written undertaking in Nawaz Sharif ECL case

LAHORE: The additional attorney general (AAG) has rejected the written undertaking submitted by the Sharif in the Lahore High Court, ARY News reported on Saturday.

The Sharif family had submitted a written undertaking in the Lahore High Court, ensuring that former prime minister Nawaz Sharif will return back to the country after getting fit.

The two-member bench headed by Justice Ali Baqir Najafi, comprising Justice Sardar Ahmad Naeem is hearing the plea filed by PML-N seeking unconditional removal of former prime minister Nawaz Sharif’s name from Exit Control List (ECL).

A handwritten affidavit was submitted by the lawyers of Nawaz Sharif and Shehbaz Sharif in the court.

“The former premier will return back to the country, as soon he gets well”, the affidavit reads.

“Sharif will also face the cases registered against him.”

The affidavit was handed over to the government lawyers for review by the court. The AAG after reviewing the affidavit rejected it.

“The draft submitted by the Sharif family has legal obstacles”, the AAG said and added that we are making a draft for submission in the court.

Earlier, the Lahore High Court (LHC) asked the lawyers of the Sharif family to submit a written undertaking ensuring the return of former prime minister Nawaz Sharif will return back to the country after treatment.

The bench in its remarked said that we want a peaceful solution to the matter. The court asked, can the condition be placed for removal of someone’s name from the ECL?

To this, the Additional Attorney General said Nawaz Sharif is allowed to travel abroad the treatment. “If the court was satisfied, the government has no objection”, he replied.

Shehbaz Sharif said he is assuring the court that his brother will return back to the country, as soon as he gets well.

The lawyers of the Sharif family informed the court that Shehbaz Sharif is ready to give a written undertaking assuring Nawaz’s return.

The bench asked the federal govt’s counsel that, do they have any objection if Shehbaz Sharif is submitting a written undertaking that his brother will return to the country after treatment?

“We have no objection”, the government lawyers replied.

Later, the court adjourned the hearing of the case till 2:30 pm.

It may be noted that yesterday, the LHC had rejected a plea by the federal government and the National Accountability Bureau (NAB) seeking to dismiss a petition of Nawaz Sharif for being “non-maintainable.”

A division bench, headed by Justice Ali Baqir Najafi, had ruled that this court can hear the PML-N supremo’s petition through which he sought directives for the government to strike his name off the no-fly list so that he can go abroad for medical treatment.

The federal government also submitted its reply in Lahore High Court (LHC).
