Justice Erum Sajjad was hearing the case filed against the two year jail sentence by a local sessions court. The counsel for the Afghan nationals said that they had sought refuge in the country due to the volatile security situation and ongoing war in their country.

They had entered the country without proper documentation and were staying in Gujrat where they were arrested and sentenced to two year imprisonment. They wanted to seek asylum in the country through legal procedures. They urged that their arrest should be declared null and void.

The government counsel apprised the court that 34 people including Raheemullah, Naseen Khan, Wali Gul and Saher Gul were illegally living in Gujrat. They were not just without proper documents but were also involved in illegal activities and were convicted by a court in 2015.

They had appealed against the conviction which was turned down by the district and sessions judge. After the arguments, the court rejected their appeal plea and maintained the conviction of the sessions court. It ordered that they should be deported after completion of their jail term.
